ACKNOWLEDGEMENT OF RISK

I acknowledge that sailing and boating activities involve inherent risks and dangers that may result in personal injury, illness, property damage, permanent disability or death.

Such risks include, but are not limited to:

Falling overboard.
Slipping, tripping or falling on board a vessel or marina facilities.
Being struck by a boom, rope, winch, sheet, block or other sailing equipment.
Vessel collision or grounding.
Exposure to wind, waves, rough seas, lightning, storms or other adverse weather conditions.
Capsize, knockdown or vessel emergency.
Physical exertion, fatigue, dehydration or seasickness.
Equipment failure.
Drowning, hypothermia or other water-related injuries.
Rescue and recovery operations.
The actions or omissions of other participants or third parties.

ACKNOWLEDGEMENT OF RISK

I understand that no amount of care, instruction or supervision can eliminate all risks associated with sailing activities.

Refrain from conduct that may endanger myself, the vessel or others.

While participating in the course, I agree to:

Wear a PFD whenever directed.
Properly secure and maintain the PFD while worn.
Immediately notify staff if a PFD appears damaged or unsuitable.

The Course Provider reserves the right to:

Alter course content.
Modify training locations.
Delay activities.
Suspend activities.
Reschedule activities.

Normal wear and tear and accidental damage occurring during ordinary supervised training will generally not be charged to participants.

The Course Provider reserves the right to refuse participation to any person reasonably believed to be impaired.

I will not participate in any sailing activity while affected by: Alcohol. Illegal drugs. Prescription medication that impairs my ability to participate safely.

RELEASE AND WAIVER

To the fullest extent permitted by law, I acknowledge that I participate voluntarily and at my own risk.

I release and discharge the Course Provider, its directors, officers, employees, contractors, instructors, volunteers, vessel owners, skippers and agents from all claims arising from injury, death, loss or damage suffered by me in connection with my participation in the course, except to the extent that liability cannot lawfully be excluded.

INDEMNITY

To the extent permitted by law, I indemnify the Course Provider and its representatives against any claim, demand, loss, liability, cost or expense arising from:

My negligent conduct.
My breach of this agreement.
My failure to follow instructions.
Damage caused by my reckless or unlawful behaviour.

PHOTOGRAPHY, VIDEO AND MEDIA CONSENT

I consent to photographs and video recordings being taken and used for training, promotional, marketing and social media purposes. I do not consent to photographs or video recordings being used for promotional purposes.
